Alabama and Mississippi: Primary Day In the South

It isn't exactly Super Tuesday today, but the four candidates for the Republican nomination for president are chasing momentum - and 119 delegates - going into the four primaries being held today in Alabama, Mississippi, Hawaii and American Samoa.

Recent polling indicates that Mitt Romney, Newt Gingrich and Rick Santorum are in a statistical dead heat in Mississippi and Alabama, the two primaries today with more meaningful delegates tallies up for grabs: 50 in Alabama and 40 in Mssissippi, all awarded proportionally. This means more than one candidate could emerge on Wednesday with delegates from each of these states.

In addition to offering the largest delegate prizes, Alabama and Mississippi are important trump cards for the remaining GOP candidates, who are all trying to build on their cases that they would indeed be the best nominee to represent the party. Party leaders argue that the south is an important region for any Republican candidate to win.

"If you don't win the South, you don't win the nomination" Sue Everhart, chairman of the Georgia Republican Party said? in an interview.?

Of these three candidates , Gingrich might have the most to gain by winning these states in terms of momentum. More than two months into the primary season Gingrich has only won two states- one of which was his home state of Georgia.

"Gingrich wants to prove that he can win outside of Georgia," said ABC News Political Director Amy Walter.

Gingrich has spent a lot of time campaigning in the two states, and he has lobbied the argument put forth by Sue Everhart against GOP frontrunner Mitt Romney, saying that if Romney can't win that region,? he won't be the nominee.

Romney and Santorum also have something to prove by winning these states. Romney is looking to show that he can indeed seal the deal with the more conservative, Evangelical wing of the party, which is stronger in the South. Santorum is looking to further his argument that he's the true alternative to Romney, and build on his win in Kansas?over the weekend.

"Santorum wants a win so he can solidify his standing as the "undisputed" conservative alternative to Mitt Romney" said? Walter. "And, Romney wants to put to bed the narrative that he can't win in southern states with large Evangelical populations."

Each of the Super PAC's supporting but legally barred from coordinating with the three aforementioned candidates have spent considerable amounts of money on ad buys in these two states. "Restore Our Future," the group supporting Romney, has spent the most money by far: $1.3 million in Alabama and roughly $940,000 in Mississippi, according to their FEC disclosures.

The figures for "The Red, White and Blue Fund," the group supporting Rick Santorum, and "Winning Our Future," the group supporting Gingrich are much lower than Restore Our Future, but they're still significant. The Red, White and Blue Fund has spent $275,000 on ad buys in Alabama and $223,000 on ad buys in Mississippi. Winning Our Future has spent a little over $299,000 in Alabama, and a little over $240,000 in Mississippi, per FEC disclosures.

There are key counties to watch in both of these primaries on Tuesday. In Alabama, Mobile and Baldwin counties will be very important. This is the part of the state where Arizona Sen. John McCain beat Mike Huckabee in 2008, and Romney placed second in these two counties.

The area also counts a large Catholic population, according to the Roman Catholic Archdiocese. Exit polls have shown that this is a group which tends to support Romney even though both Santorum and Gingrich are Catholic. In Michigan for example, Romney took 44 percent of the Catholic vote, where Rick Santorum took 37 percent. In Ohio Romney took 44 percent of the Catholic vote as well, and Santorum lagged behind with 31 percent. Large turnout in these populous counties will likely bode well for Romney with these figures in mind.

In Mississippi, the county to keep an eye on is Rankin county, which is located in the south central portion of the state and is part of the Jackson metropolitan area. ?Growing fast, Rankin county is heavily Republican - McCain carried the county with 76 percent of the vote in the 2008 general election- and has the third highest per capita income in Mississippi according to the 2010 census report.

In 2008 Rankin cast the most votes of any county in Mississippi's primary. If that trend continues this year, and Romney can carry this county, his chances of winning the state will be good.

Hawaii and American Samoa host caucuses today as well, with a total of 29 delegates up for grabs.?Twenty delegates are at stake in Hawaii, nine in American Samoa. Both caucuses are only open to registered Republican voters, according to party officials.

In 2008, McCain received the overwhelming majority of support in both Hawaii and American Samoa.?Although none of the candidates have personally made visits to either locations, Romney Paul and Santorum have each sent their children to campaign for them in the Aloha state.

After Tuesday night the attention shifts back to the Midwest. Missouri will hold its caucus March 17, and the Illinois primary is scheduled three days after that, on March 20.

Yahoo sues Facebook for infringing 10 patents - The One Media ...

SAN FRANCISCO (Reuters) ? Yahoo Inc sued Facebook Inc over 10 patents that include methods and systems for advertising on the Web, opening the first major legal battle among big technology companies in social media.

The lawsuit, filed in a San Jose, California federal court on Monday, marks a major escalation of patent litigation that has already swept up the smartphone and tablet sectors and high-tech stalwarts such as Apple Inc, Microsoft Corp and Motorola Mobility Holdings Inc.

Yahoo?s patent lawsuit follows Facebook?s announcement of plans for an initial public offering that could value the company at about $100 billion.

Facebook spokesman Jonathan Thaw said Facebook learned of the lawsuit through the media.

?We?re disappointed that Yahoo, a longtime business partner of Facebook and a company that has substantially benefited from its association with Facebook, has decided to resort to litigation,? he said.

In an emailed statement, Yahoo said it is confident it will prevail.

?Unfortunately, the matter with Facebook remains unresolved and we are compelled to seek redress in federal court,? the company said in a statement.

Yahoo, one of the Web?s pioneering companies, has seen its revenues decline in recent years at a time when rivals such as Facebook and Google have thrived. In January, Yahoo appointed former PayPal President Scott Thompson as its new chief executive, replacing Carol Bartz, who was fired in September.

Yahoo said late last month it was seeking licensing fees from Facebook over its patents and that other companies have already agreed to such licensing deals.

IPO COMPANIES VULNERABLE

Colleen Chien, a professor at Santa Clara Law in Silicon Valley, said companies are usually more vulnerable to patent suits when they are in the IPO process.

?As a general proposition, when a company is about to go public, the last thing it needs is to get involved in a knock-down, drag out litigation fight,? Chien said.

?So that might make Facebook more willing to resolve its differences with Yahoo.?

Yahoo has used similar timing to its advantage in the past. Google agreed to issue shares to Yahoo nine days before Google went public in 2004 in exchange for a license to Yahoo?s patents. Google later took a $201 million non-cash charge related to the transaction.

In deciding to sue Facebook, Yahoo has retained the same law firm, Quinn Emanuel Urquhart Sullivan, used by Google and other manufacturers in many Android-related smartphone patent cases. Google is a player in social media with its Google+ service.

Quinn Emanuel also counts social gaming service Zynga Inc as a client, according to the law firm?s website.

Yahoo has not said whether it will bring patent claims against other social networking companies and a Google spokesman declined to comment on Quinn Emanuel?s involvement. Zynga also declined to comment.

In the lawsuit, Yahoo says Facebook was considered ?one of the worst performing sites for advertising? prior to adapting Yahoo?s ideas.

?Mr. Mark Zuckerberg, Facebook?s founder and CEO, has conceded that the design of Facebook is not novel and is based on the ideas of others,? the lawsuit said.

ONLINE ADVERTISING

Only two of the 10 patents at issue are directly related to social networking technology. Most focus on online advertising, including methods for preventing ?click fraud,? as well as privacy and technology for customizing the information users see on a Web page.

?If what Yahoo is saying is literally true, then it seems like a lot of companies would be liable,? said Shubha Ghosh, a professor who specializes in intellectual property at The University of Wisconsin Law School. But he added, much would depend on whether a judge defines the patents broadly or narrowly.

Several social networking companies, including Facebook, have seen an uptick in patent claims asserted against them as they move through the IPO process.

However, most of those lawsuits have been filed by patent aggregators that buy up intellectual property to squeeze value from it via licensing deals and none by a large tech company such as Yahoo.

The lawsuit is a change for Yahoo because the company has never initiated offensive patent litigation against such a large publicly traded company, according to a search of federal court dockets on legal database Westlaw, a Thomson Reuters unit.

A classic defense for companies targeted with patent claims is to threaten a countersuit using its own patents. But Yahoo possesses far more patents than Facebook. According to a U.S. government database, Yahoo has over 3,300 patents and published patent applications, while Facebook has 160.

The case in U.S. District Court, Northern District of California is Yahoo Inc. v. Facebook Inc., 12-cv-1212.

America is back. You can tell because Americans are maxing out their credit cards again.

Household debt grew at an annualized rate of 0.25% in the last quarter of 2011, according to the Federal Reserve?s flow-of-funds report released last week. That?s not a big jump, but until now there hadn?t been any uptick at all in household debt since the 2008 crash.

?Consumers have been more willing to use credit cards for shopping, signaling renewed confidence in their financial and job prospects,? explained Paul Edelstein, director of financial economics at IHS Global Insight, in a recentAssociated Press report.

Banks are lending, consumers are borrowing and China is busy making us more stuff.

That is the precise technical term for where our debt-addicted economy is headed.

Mr. Hyman is a former McKinsey consultant, a Harvard Ph.D., a Cornell University professor and author of ?Borrow: The American Way of Debt.?

His book, released in February, is an entertaining romp through the history and culture of credit. It points out that while borrowing has been around for millennia, it was used to finance production, not consumption, for most of that time.

This thing we take for granted, buying houses, cars and electronic gizmos on credit, is a relatively recent development. It created the middle class we know today, but it?s also destroying it.

?We haven?t really dealt with the underlying causes of the crisis,? Mr. Hyman says.

And the most basic cause is this: ?Consumer debt has crowded out business debt. ?GE Capital can make more money issuing credit cards to consumers than it can loaning money to businesses.?

Indeed, the interest rates charged for many consumer loans used to be prosecuted as criminal offenses. Banks bought off the lawmakers and became loan sharks with risk-management models singling out borrowers they know can?t repay?ruining them and everyone around them as their subprime debts choke the economy.

Mr. Hyman argues our economy will never be fixed until government policy encourages credit to flow more freely to those who produce and less freely to those who consume.

If capital is invested in businesses that can create decent-paying jobs, then maybe people won?t need so much credit to buy the things they consume.

Our grandparents would have never imagined taking out a loan for a bite to eat. Anyone who charges a pizza and doesn?t pay off the balance at the end of the month eats debt for dinner.

Americans do not need to eat like this. They need jobs. But the great allocators of capital known as Wall Street would rather keep flipping debt-backed securities. And the great drivers of the U.S. economy known as consumers are increasingly stuck with low-paying jobs and high-interest credit cards.

?When it is more profitable to build an electric car than to invest in a credit card, we will know that the crisis is over,? Mr. Hyman writes in his book.
